After the moot court has met, prepare a five-page opinion that shows how you believe the Supreme Court would evaluate the constitutionality of Secretary Sebelius’s attempt to reconcile her competing duties. We strongly encourage you to submit your judicial opinion within 24 hours of attending your moot court, but will accept them as “on-time” by Sunday, March 16, at 5:00 p.m., as an attachment to an Oncourse message addressed to “instructor role.” 1) a clear statement of your position about the constitutionality of the ACA’s requirement for Hobby Lobby to provide healthcare with contraceptive coverage to their employees;
2) a reasoned and informed argument for (or against) recognizing a civil and constitutional right for Hobby Lobby to a free exercise of religion, which would not entail paying for their employees’ contraception;
3) a reasoned and informed argument for recognizing the federal government’s obligation to ensure access to health care coverage AND/OR the government’s duty/interest in ensuring access to a governmental program in a way that does not impose one group’s religious requirements on others who may not share those beliefs (i.e., avoiding Establishment of Religion);
3) a reasoned and informed argument explaining why the Court should take your approach to reconcile its free exercise and other (perhaps including establishment) duties/interests.
