Management

Option 1 is essentially a literature-based assignment, where participants are required to produce a Management Report on the following using the materials provided in the module, plus personal reflections, further to reading, research and discussion: In the introduction, you have to define what leadership is, what is the difference between a manager and a leader. In the first part, you have to include at least 2-3 leadership theories that exist and discuss their application/use within business. In the second part, you must explain the different relationship between men and women with leadership in companies. You must speak about the “glass ceiling” (define and explain it) that prevent women to evolve in a company and also explain that today women have “2 works” (in a company and at home) and it may be a reason why they have difficulties to break the glass ceiling because managing work and housework give stress and can be a reason why women are “stuck” in this situation contrary to men (imbalance between genders). In the third and last part, you must provide recommandations to avoid this imbalance within an organization (speaking of laws on gender male / female), give examples of women who have succeeded.

Improvement Approaches in Health Care Settings

Improvement Approaches in Health Care Settings
Health care organizations, by their nature, must constantly strive to improve patient care. Many different approaches to improvement have been utilized over the years. In this discussion, you critically evaluate a number of these historical and contemporary approaches and consider what is most effective. You then apply those approaches to your case study, and analyze the effect they might have had on the outcome of that case.

To prepare for this Discussion, complete the readings in your Learning Resources.

• Review this week’s Learning Resources, specifically Grol (2001).

Post by Day 4, a description of two historical and/or contemporary approaches to quality improvement you feel would be most effective to improve health care quality and safety. Then, evaluate how these approaches could be applied to the case study you identified in Week 1. Finally, analyze how adapting these approaches might have altered the outcome in that case study.

Group Analysis – Applying Theory in Practice

Students will need to select a group such as a sporting team, community group, work team, housemates etc. and analyse the nature and operation of the group based on principles and approaches covered in the course and the readings. You will need to prepare a 3000 word assignment based on the outline below. You will find the assignment easier if your group is one with which you have a reasonably long-term and close connection. However, your group does not have to be like this. It could be quite flexible such as an art group or volunteers on a project etc. It needs to have enough elements to make your assessment of the group meaningful and comprehensive.
You will need to document a full analysis of the structure of, development of and interaction within your chosen group, and present your material in ways which most effectively deliver the information about your group. You will need to choose a group to analyse and also apply or reflect on a group technique. To prepare the report you need to do the following:

A. Select your group and analyse your group – A group can be informal or formal. Collect all the relevant information (reports, observations, interviews and/or survey instruments)

B. Apply or reflect on a group technique – Choose and conduct a group technique with the group. This could be conducting a focus group, facilitating a planning meeting, observing group interactions, surveying group members etc. Analyse how the process went and describe how it went and what came from the technique.

C. Use the following format to prepare your report:

1. Introduction

Make the readers want to hear more about your selected group
Tell the readers how your report is going to be organised
Set the stage for the conclusion.
2. Analytical discussion (body of the report)

Describe the selected group – general information (historical perspective of the group, functions, objectives, etc.)
Describe the structure of the group
Describe the stages of development of this group
Discuss the task behaviour and maintenance behaviour within the group
Analyse the roles played by executive members of the group (analyse team role behaviour)
Discuss the leadership structure and roles
Analyse conflict of interests in this group and its management strategies
Analyse the dysfunctional behaviour and its effect on group goal achievement
Effectiveness of this group.
3. Group Technique

What approach was chosen or negotiated with the group and why?
What group technique was chosen and why?
Discuss how the process went.
4. Conclusions and recommendations

Summarise your arguments and conclude what this group demonstrates about group processes, leadership and conflict management.
What could be done (by you or other members) to improve the functioning of this group?
5. Learnings

Personal learning: What have you learnt from conducting this analysis?

6. References – At least 8 references required

Reference MUST be made to your course materials and to readings. Read the referencing systems carefully and cite the reference(s) in the appropriate place and manner in your report. You have to demonstrate your professionalism in analysing and preparing this report.

company law

Florid Flicks Pty Ltd is a company that produces various artworks in print and other media. The company has three shareholders Mick, Muldoon and Kim who each have an equal number of voting shares. The company has two directors Mick and Muldoon.

The company owns some beautiful drawings (‘the drawings”) prepared by Sarah a well know artist which have a commercial value of $250,000.

Florid Flicks Pty Ltd is having a cash flow problem and the company’s record keeping has been poor.

One of the directors Mick thinks everything will be all right eventually and keeps commissioning new products for sale but is paying ongoing expenses of the company out of money previously put aside to meet income tax and GST payments.

The other director Muldoon takes no steps to monitor the company’s position and is unaware of Mick paying expenses out of money set aside for tax payments.

Mick ponders that if Florid Flicks Pty Ltd fails then the liquidator would end up with Sarah’s drawings. Mick and Muldoon pass a directors’ resolution donating the drawings to the National Museum.

Mick and Muldoon decide to convene a members’ meeting whereby they pass a resolution ratifying the donation to the National Museum. Kim votes against the resolution.

Kim is also employed full time by Florid Flicks Pty Ltd as the Gallery Manager. In her position as Gallery Manager Kim constantly talks to various artists about new artworks and exhibitions. Recently she has been talking to Sarah about her fears for the future of Florid Flicks Pty Ltd and Sarah has agreed to provide all her future artwork exclusively to a new company Kim has just formed called Thursday Night Lights Pty Ltd

Have Mick or Muldoon or Kim contravened any of the statutory duties imposed upon them by the Corporations Act or any corresponding general law duty?

(16 marks)

Would the members resolution ratifying the directors actions cure any breach of any applicable statutory or general law duties?

(8 marks)

Kim wants to stop the donation of the drawings to the National Gallery or failing that to recover the value of the drawings from the directors. What options are available to her under the Corporations Act?

(16 marks)

INSTRUCTIONS FOR ASSIGNMENT

Start your answer to each question on a fresh page.

When answering each question, ensure that you:

identify the issue(s) raised by the facts
identify the relevant legal principles
apply the relevant legal principles to the facts
reach a conclusion

This is known as the IRAC method

I = Issue
R = Rule of law
A = Application to the facts
C = Conclusion
Issue – Decide from the facts what the major issues are. It will help to break the facts down by identifying who are the main parties, what are their relationships and what transactions have been entered into or events occurred?

Rule – With your knowledge of the Corporations Act, case law containing company rules, and other sources of company law, you need to make a decision about which legal rule or rules are relevant to the facts before you. Having identified the right rule or legal principle, you need to state it clearly and state where it comes from.

Application – You will then need to “apply the law to the facts”.

Conclusion – You should come to a conclusion based on your argument.
