Case Study Instructions:
1. Each student will be required to create a hypothetical business in which he/she is the owner and chief operating officer. You will describe your business by indicating what it does, how many employees it has, what type of business entity it is (e.g., sole proprietorship, partnership, corporation, Limited Liability Company ((LLC)). This same hypothetical (or real) business may be referred to in each hypothetical (case study) if you choose (you can create a new business, if you wish). On the week you have been assigned to post, you will create a fictional legal scenario (legal problem concerning the business  also referred to as a case study) involving an issue covered in the current weeks reading and apply the legal principles found in your textbook readings to your hypothetical business. If the students business is a shoe store, the student might explain how the issues covered in the current weeks readings affect his/her shoe store. For example, if the weeks readings covered the legal issue of breach of contract, the student might create a scenario in which an unhappy customer wants to return a pair of six month old, previously worn shoes. Further, the student will explain any legal options that might be open to the business owner, as well as to the customer and how those legal options would probably get resolved. This posting should be 400 to 500 words and should include the identity (or link) to any references used, and any additional information or research deemed pertinent by the student. A sample case study will be posted in the Course Documents module in Blackboard.

2. The idea here is to stimulate discussion with and among your classmates and to generate genuine interest and excitement for the class. Outside research shared with the class is required to receive full credit. Use your ability to create links, or any other online tool available to you. Do not use Wikipedia as a resource although that website is informative, it is also collaborative and not suitable for scholarly writings. Points will be awarded based on the quality of writing (grammar, punctuation, spelling, word usage, etc.), the quality, relevance and complete nature of the submission; the students explanation of why the issue is of significance to business administration students; and the outside research and insight you bring to the class. The idea here is to have fun while learning.

*Legal Issue
A cabana attendant at our resort property in beautiful Ma’alaea Cove in Maui has recently been terminated after several verbal and written warnings for his violation of our sexual harassment and dress code policies. The cabana attendant was seen wearing his pants below his waist, exposing his underpants to several co-workers. The other employees felt like it was a case of reverse sexual harassment, the issue was addressed with a verbal warning. A week later, a guest noticed the cabana attendant’s underpants when he lifted his shirt to wipe sweat from his brow. Management was informed and the employee received a written and final warning. Management stressed that he was not to wear his clothing in a manor that would expose any part of his underpants. The employee was also told that employees are required to have their shirt tucked in while at work. The employee followed policy for another week when another client, an owner this time, witnessed the employee remove his shirt, loosen a belt, and expose his underwear. The employee was observed by several people walking across the grounds towards a parking lot and eventually to a parked car in which he entered and left the premises. Management was made aware of this by the very angry and embarrassed owner, who was entertaining his grandchildren at the time the employee removed his shirt and loosened his belt. The employee was terminated the following day upon his arrival to work.
*Resolving the Legal Issue
The employee explained that he was off duty, that he had just punched out, on his way to his car, and was “really, really hot.” We reminded him that after his first two warnings, that the violations would no longer be tolerated due to the prestigious nature of our clients and the value we hold in our wonderful properties. After termination, the employee sought an attorney, who made us aware of his client’s intent to sue WSI for wrongful termination based on discrimination. The former employee’s attorney argued that WSI discriminated against his client’s way of dress, because the position of his pants, in proximity to the waist, was not clearly defined in the employee handbook’s section about the dress code. WSI and our attorneys argued that the employee was made aware of the policy after the initial complaint and subsequent warning. The second instance was considered insubordination and the third violation became reasonable cause for termination. The lawsuit was dropped by the former employee when WSI agreed to proceed with the suit and was uninterested in settling out of court.

Background information—including a literature search, interviews etc. utilizing at least 10 different references cited in A.P.A. style in your paper and listed in your reference list. Investigate the background of the problem, need, situation or issue that you have identified. Use current references citing them in A.P.A. style. You may also want to interview experts in the area.

Proposal of at least two solutions or recommendations. After analyzing the information you have collected, propose at least two solutions or recommendations for the new initiative, need, situation, issue, or problem. Identify each one in a separate section of the paper.

4. Evaluation of the solutions or recommendations and choice of the primary solution or recommendation with a rationale for that choice. Evaluate your proposed solutions or recommendations. Decide which one best meets the needs of the organization. Give a detailed rationale for your choice. Be sure to address all the areas that you will be evaluated on. Consult the evaluation form for your major. At least 80% of the Senior Project must be your own reasoning and analysis.

1 Public Duty Scenario Physicians

(Physicians The patient-physician relationship is essentially a contractual relationship. The physician is under no duty to treat (accept) a patient. Whether the patient can pay or not, and regardless of the patient’s medical condition, a physician is not legally obligated to treat. A Texas court asserted: Since it is unquestionably the law that the relationship of physician and patient is dependent upon contract, either expressed or implied, a physician is not to be held liable for arbitrarily refusing to respond to a call of a person even urgently in need of medical or surgical assistance provided that the relationship of physician and patient does not exist at the time the call is made or at the time the person presents himself for treatment. [Childs v. Weis, 440 S.W. 2nd 104 (Tex.Civ.App.1969)] It is assumed therefore, that a relationship exists between the physician and the patient, and that relationship is, from the beginning, a contractual and voluntary relationship. [Agnew v. Parks, 343 P.2d 118, 123 (Cal.App.1959)]. Once a contractual relationship is established, either expressed or implied, then the physician has a duty to perform and can be held liable for any failure or shortcomings on his or her part.

2 Public Duty Scenario Hospitals

Health care organizations now function under a series of statutory and court created laws that effectively prohibit the arbitrary refusal to admit and treat patients. A Delaware case applied common law to this question and found that a hospital has a duty to act reasonably in its patient selection decisions. The historical custom of hospitals to maintain open emergency rooms has influenced the development of case law. The courts have therefore build upon the concept of negligent termination of gratuitous services and maintain that hospitals should be responsible in cases of “unmistakable emergency” to stabilize patients prior to transferring them to another facility. [Wilmington General Hospital v. Manlove, 174 A.2d 135 (Del.1961). This case had its greatest impact on the duty to treat indigent emergency patients and little effect on the duty to treat insured patients. In a later case, [Payton v. Weaver, 182 Cal.Rptr. 225, 131 Cal.App.3d 38 (Cal.App.1d 1982)] the court suggested that where even private hospitals had a “quasi public” character, paying patients had a right of access and treatment. This was stated because hospitals have a unique and sometimes scarce service, that they receive funding from public sources, and have a tendency to enjoy monopoly status in a community. Further, federal regulations require hospitals that enjoy a tax-exempt status or received construction grants under the Hill-Burton Act to treat all community patients. Institutions that receive Medicare and Medicaid funding are prohibited from discrimination.
