                A Study has shown that, English learners have the highest drop out rates and frequently in lower academic track and in lower capability than other languages in the majority of students (Echevarria, et al, 2004).  Teaching the Second language to various ages and language groups, requires an individual teaching to have effective methods of passing the knowledge. Students in secondary schools may learn the language proficiently but this is not the case to elderly group. Statistics have shown that, 30% of secondary students learn the language expertly; however for students belonging to different language groups the situation may be worse. 86% of African American students along with 89% of Hispanic students, read below grade level (Smiley et al, 2007).  Smiley argues that, only 10% of young adults that speak English at home do not succeed to complete high school. In his research he points up that, a number of reports in United States have focused attention on the increase of the number of English learners students from high school not receiving a diploma due to failed high stakes grades.  There is a need to make students from different races as well all age groups in acquisition of English as the second language and achievement to make the learning successful. There are various methods and techniques used in teaching the second language to different groups as well as races. In order to come up with the best approaches, there is a need of understanding learners’ backgrounds. Therefore, different methods in teaching are significant for second language learners in school because, individuals are not alike and have diversity in their ages, personal experiences, and educational background among others.

Communicative technique is one of meaningful approach used for English learners’ language (ESL) teaching preparation. The method is most successful in teaching students in high schools and colleges. The students are given a chance to discuss their materials on high interest and topicality that later motivate them to learn and participate fully in the classroom. Students are encouraged to test the language and presume greater accountability for their learning process. It engendered the content based of ESL approach through viewing grade level curricular relevant and meaningful to the students. In content, the language is taught by language educators whose main objective is to make English skill improvement and prepare students in English medium classroom (Goldenberg et al, 2010). The material addresses the major topics in grade level subjects but do differ according to the language proficiency of the students in the classroom.

The use of multiple subject areas is often used in interdisciplinary units or thematic. For instance, in a primary classroom, a theme of life on a farm can be used to make the learning helpful. While students in primary school learn such language related terms as names of animals, names, the present continuous tense and adjectives will also have an addition knowledge on reading poems, singing songs about the farm and animals, discussing the food chain,  thus exploring on language arts, numbering in mathematics, music along with science. For high schools students, a theme such as urbanization can be selected and lessons could consist of objectives that are drawn from the environmental science, world history, geography, economics and algebra.

As a result of learning these concepts, the students with less proficiency in the process take field trips around a local city and create maps, brochures and transportation routes. On the other hand, advanced students learn to make use of reference materials with computers to do researches on the growth of cities in addition to their respective population growth. This concept makes the learning interesting together with students studying a persuasive language to debate on the disadvantages and advantages of urbanization. In general, it seeks to develop students through incorporating information from the subjects’ areas that the students are familiar with in consequence making the learning enjoyable (Smiley et al, 2007).

Teachers can modulate the level of English used by students comprehensible through the use of visual aids, demonstration, vocabulary previews, modeling, peer tutoring and support of native language. Second language acquisition can be promoted through social interaction in addition to contextualized communication through the teachers guiding the students to construct sentences and understand the complex concepts from texts and in the classroom discourse (Fay et al, 2004). They are also taught how to give their opinion on the meaning, a time may be encouraged to argue, disagree and the teacher giving the best opinion among what they have discussed.  Tutors can introduce the learners to demonstration skills through conversation and asking for clarification for the content of the knowledge.

In a different culture, tutors consider a cultural background learning styles in teaching the second language. They allow students to interact in order to build the students potentially in different ways of behaving, learning and using the language. Depending on the learner ability level, trainers offer multiple pathways to learners in understanding their content point of view. For example, tutors might prepare pictorial hands on, performance based for different individuals in group projects, written assignments, oral reports and various measures that include quizzes to help in checking the student comprehension together with language growth. This can enable teachers have an accurate picture of the progress of the learners through content knowledge along with skills by assessment measures of the tests. Therefore, the old aged group requires a greater exposure in the level of acquiring a second language. The most successful tutor promotes learning with interactions by use of collaborative groups. Grouping the elderly English learners together with non English learners, develop skills for this age group learns the second language. Access of the information and finding out what they have experienced about the language, provides the knowledge directly to the lesson understanding and its objective (Echevarria et al, 2004). Teachers should use visual and other types of concrete materials that will make the beginners of the language understand for some learners are more visual than others. Therefore, this concept is universal in education to all learners that belong to different age groups and different cultures. For teenagers, instructors should use limited input that should be straight forward. This is due to the fact; they cannot concentrate for a long time. An audio tape is also effective in giving learners opportunities to hear the passage. The passage may be read slowly in clear enunciation for beginning learners who may experience difficulties in difficult words.

Finally, lesson preparation is a critical foundation for delivering a high quality lesson. Good planning leads to effective teaching.  In the learning process, there is a requirement for sensitive tutors that should realize that curriculum ought to be a grade level that is based on learning outcomes. Lessons that are outlined by the trainers should help students in reading, writing as well as discussing important concepts and ideas (Terrell et al, 2006).

            Mass media defines all methods of information that is communicated to large group of people. This includes the television, newspaper, the radio, computer, the fliers and anything that delivers information. There is no specific standard for how large the audience has to be before communication becomes mass communication. There has been a lot of controversy  concerning the influence of the mass on the young people. This has ended up having an influence on their positions and opinions. This is because there are no constraints on the type of information being delivered. As many individuals see the negative influence the mass media has on the young people, the positive effects can not be ignored. This paper will have a look on the merits the media can have on the youths.

Mass media can be used for educational purposes in a very effective manner. The youths can be gain knowledge on certain areas of life. Some of these areas include politics, health, science, environment, drugs, career, and current news. One of the main advantages of mass media is that it can reach a large number of people within a very short time. It reduces the distance between human beings, it makes the world look smaller due to access to information and increase in communication (Harris 2). As a result it makes the people be close to each other in terms of thinking and space. Mass media can allow a young person to participate in activities and occasions in some other parts of the world. Through mass media they can know about the tsunamis, influenza outbreaks, earthquakes and other events taking place in the world.

Mass media can inform the youths on the political situations in other countries as well as their own countries. This as a result, will not make them ignorant concerning the political ‘air’ in the world. This can also be of help in their history class and knowledge. Such an example is the rise in cost of fuel around the world as a result of political unrest in the Arabian countries. This has caused a sharp increase in the cost of living, and it will be easier for the youth to understand the economic times (Vipond 2).

Most people have known about their medical condition, through the mass media. Thanks to Google and other search engines. The youth gets to type the symptoms he/she is experiencing and the type of disease is just a click away. Television, radio, internet and newspapers have also played a significant role in educating the public on their general well-being. This mostly concerns their health, where mass media educates the public on activities and foods and activities to avoid so as avoiding a certain disease or how not to aggravate it. This has proved to be very beneficial especially to individuals who cannot afford the consultation fee so as to get those services (McCombs & Shaw 1).

The mass media has also been of importance especially in the conservation of the environment. This is seen in the programs, advertisements it creates so as to educate the public on the importance of taking care of the environment. Encouraging the public to plant trees, recycling and proper disposal of waste products has been of great help. This has been possible, through the partnership of mass media and environmental organizations so as to bring forth the campaigns on conserving the environment.

The youths have fallen prey to various immoral activities including drugs and substance abuse (Deephouse 1). The mass media has intervened through creating awareness on the adverse effects of these drugs as well as how to avoid and get out of them. For those who are already in drugs, mass media goes ahead and advises on the various rehabilitation facilities in the country. The many campaigns against drug abuse have been very helpful especially on the youths (Foulkes & Katz 2). Mass media on the other hand, can be used as a way of making the youths is aware of their rights. Incase these rights have been abused, they can be advised on the legal steps to take so as to fight for justice. This has proved to be helpful in making the youths to know what actions calls for legal steps and what can be solved by the help of their parents.

The mass media also educates the youths on the various career options they can pursue and the various colleges they can attend. For those who are through with college, the mass media has been of help in the job search. Many people also study online, instead of having to travel miles so as to get to that particular college. This has also helped individuals in other countries t get access to prestigious colleges that are not in their country. The internet as also has been of great help in students who are doing a research on their assignments or projects (Klein, et al 1).  This has been beneficial especially if one cannot get the book their lecturer wants them to use. Many people have landed in their jobs as a result of advertisement on the mass media. The many job opportunities worldwide are advertised through the mass media. One only has to sit down in the comforts of their house or rooms and search for a job either through the internet or through newspapers (Olien, Donohue & Tichenor 1).

According to Arnett (1),   many countries are using the mass media to create awareness on the rising cases of HIV and AIDS. This has affected the whole world and has called for urgent measures to be taken. This has made the mass media to come in handy as an intermediary between the AIDS organizations and the general public or the young people. The mass media has been of great help in advising the youths to abstain or if they can not they can opt for protection. This would have been impossible if the mass media was not involved, as the spread of AIDS would have reached to an uncontrollable situation (Katz, Gurevitch, & Haas 1). As prevention is better than cure, the mass media has been given thumbs up for preventing the spread of AIDS worldwide.

The internet, newspaper and television have been a good source of ‘window shopping’. If someone wants to buy a certain product she/he has to search it on the mass media sources. This helps one to make a budget for their money (Martin 1). This has also helped parents to know how much they can give to their children to help them avoid overspending.

Acoording to Martin (1), mass media has been attributed in raising awareness on the growth in technology. In addition to this, it has also been beneficial in helping an individual to know how to use this technology. As the common saying goes, all work and no play make Jack a dull boy, mass media has been a source of entertainment for many people. The many games, movies and programs have been helpful in entertaining the youths.

Conclusion

The benefits of mass media can not be exhausted. As many parents and organizations are against mass media because of the negative influence it has on the youths, the merits can not be ignored. Parents need to monitor what their children are watching and organizations need to come up with measures to put in place so as to govern what people listen to and what they are watching. Such measures can include censoring of words or certain pictures.

Based on personal experience, the HRM has emphasized on certain qualification when recruiting employees that include having at least two-year work experience. Eventually, this has ensured effective work performance in that many tends to share their previous work experience with other employees within the organization. As a result, there have not been performance difference instead; improvement on each individual performance has been outlined. By bringing qualified employees together has ensured interaction and through interaction, innovations of new ideas have been achieved along with the team and this has greatly increased our work performance.

However, there have been few cases when the less qualified have been selected for recruitment; there have been differences on wages. Occasionally, the victims have been paid based on their performance and excellence. Many have ended overworking in meeting a certain target required for them and as a result, they have ended up being less motivated. Ironically, this group of employees has worked more compared to the qualified group. This has been disruptive to the point of resigning jobs. This has posed a concern to me in that, if selection and placement were done effectively; there would be few cases of performance-based pay, which greatly discourages employees.

Paradoxically, work field have not realized the effect this has on employees. For instance, recently, there has been hearsay of education towards considering performance based pay for teachers. Based on my opinion, this may discourage the employees who might feel overworked in the name of a better salary. Borne in mind that some individuals may not be eligible, differences in work performance will be a guarantee. It is not logic for the skillful and experienced employees to perform the same duty. As this effort begins to be used in schools, various aspects will follow in place.

First, paying teachers according to their effectiveness would lead to unhealthy competition between employees towards achievement. Although competition is a mission for success, if it is overdone in the aspect of better position and payments it can create jealousy and enmity. Despite the fact, it is relatively new, many people have strongly believed that fear of unionizations would ensure that employees are treated well.  This is because, it will improve the work environment and work against corruption by ensuring that younger workers no longer require unions to get employment.

As a result, this would result to conflicts among employees particularly when some employees’ concept is sidelined. In addition, using appreciative inquiry would dilute the management in that employees would end up coming with possible solutions for development. With this in mind, employees would end up making decisions meant to be made by the management.

There are problems on Parkway Nursing care having unfavorable working conditions causing many employees to quit the job. According to Morrison, Taylor outlined that, workload result to occupation stress thus, recommending the need for organization delegating duties that suits each employee. In reality, the Taylor strongest concept is breaking down a complex task into subtasks in addition, optimizing performance of subtasks. The application of Taylor theory would yield improvement in productivity.

In addition, the Henri Fayor’s administrative theory that focuses on the importance of the management doing their duties effectively to enhance favorable working environment (Waring, 1994). The management should work effectively in five principle duties that include plan and forecast, organize, co-ordinate, control and command. In essence, Parkway management team should forecast and plan through anticipating the company future thus, acting accordingly. Organizing entails the Parkway management having enough resources, materials and skilled doctors to enhance progress. In addition, the management team should coordinate with the employee to ensure that work is performed professionalism. This can be achieved through coming up with measures that encourage employees to work hard and eradicate laziness for instance, rewarding them for their good work. Finally, control entails ensuring that work is performed in accordance aligning with rules and procedures of the organization in addition; evaluating employee performance.

In conjunction with this, the team building theory would enhance change in Parkway Nursing care in that, the theory emphasizes on the benefits of building a team work that would enhance best practices and continuous improvement. According to Anne and Smith (1992), the team building theory is important in that, it highlights the need of involving employees in decision-making. When team building theory is applied in Parkway Organization, there would be progress in that the management would recognize employee challenges thus, coming up with better solutions to improve working conditions. As a result, it would motivate employees to work since their needs would have met creating a favorable working environment.

In facts, the paper has discussed occupation stress through highlighting the major cause and effects of occupation stress. As discussed in the paper, occupation stress would be cause by having unfavorable working conditions and practices, increase workload and extremely long working hours among others. As a result, it causes employee dissatisfaction increasing Turnover rate, absenteeism and low working performance. As discussed in the paper, Parkway Nursing care seems to have unfavorable working conditions that cause both occupation stresses. In this context, the possible solutions would be derived from Henri Fayor’s administrative theory that highlights the need for management effectively carrying out their duties to enhance a favorable working environment. Team building theory that highlights the need for building a team work that would enhance best practices and continuous improvement, and finally, Taylor’s scientific management theory that consistently outline the need of distributing work duties to employees. When this is done, it would create a favorable working environment thus, enhancing productivity along with increasing work performance. With this in mind, this paper has analyzed Parkway Nursing care in addition, examined various challenges faced by the staffs and patients.

My response to Jan Bringing sexual harassment to light

            As the Human resource manager, my core responsibility is to manage and oversee the personnel department in the Belle Tire Auto Repair Company. Am grateful for bringing the issue of sexual harassment to light. It is with doubt; this will help me as the manager to address sexual harassment issues, which for many years, have not been heard. Am sorry for your accusation towards sexual harassment, I believe sexual harassment is a very sensitive issue, which creates a hostile environment. With this in mind, I will handle the issue effectively ensuring this does not occur in the future. In monitoring the situation, I will do my own investigation using various strategies.

First, I will inquire from my disciplinary committee whether such incidence has ever occurred previously to Ron the accused. If not, I will work together with my disciplinary committee in investigating when the act was done. This will be achieved by inquiring from various employees attitude towards the perpetrator, and whether they experienced similar cases. I will work together with the employees’ representative to inquire how Ron relationship towards other employees has been for the past years. In addition, employees will assist in coming up with investigations and if any witness will inquire when the act was done. In conjunction with this, I will make use of HFCC non-discrimination policy hopefully to prevent the form of sexual harassment. It is with no doubt; this will help me to monitor the situation thus, preventing its future occurrence (Krazmer & Solotoff, 1994).

            Am concern by the fact that, you never had intentions to sexually harassing Jan. From my investigations; I have established that, there was a misunderstanding of your words being refered as sexually harrassing. It is noteworthy noting that, people come from different backgrounds and for that reason; one is required to handle each other with a lot of care. It essential noting that, uman beings have differences, which if not handled well, may result to hatred, fight and rage. I know this may affect you in your work performance especially working in the same environment with Jan. As the manager, I will communicate to the entire management and employees about your accusation as being misinformation brought by differences in how we respond to situations. To ensure that you work as a team with Ron, I will call both of you to apologize to each other in addition, ensure you work together. Eventually, I will delegate duties that both will be required to work together thus monitoring your future relationship along with being productive employees. Having encountering such a challenge, I will make use of the HFCC non-discrimination policy which I think will encourage many women and minorities to apply (American Council on Education, 1998). In order to put the policy into action, I will prohibit any form of discrimination or in the foundation of sexual harassment. In evaluating other employees’ behaviors on what is wrong or right, I will carry out my own investigations to establish the truth behind accusation.

According to this principle, all organizations are required to give truthful information to its shareholders, employees, financial institution, management and the government among others. Although this reflects genuineness of a company, it is challenging to disclose information especially when it is operating under loss and in debts to the shareholders. If the information is disclosed to the shareholders, they may end up shifting to other companies who might be operating better for fear of not sharing loss, with the company. However, if this principle is bent, it can accommodate the need of the business. In such case, the company may choose not to disclose the information on how it is operating under loss; instead, they should aim at motivating many shareholders to be part of the company. As a result, it may inspire many shareholders to invest their share in that company and eventually boost its finances without breaking the law.

According to the principle of full disclosure, all values and information of financial position should be revealed in the records. In such a case, if the company financial position is down, the principle indicates that the company should reveal such information in the records. In such a case, the company may opt to substitute this law with the principle of continuity, which delineates that, when giving financial information; one should be presume that the business financial status will not be periodic. This principle allocates that, assets should not be accounted at their disposable value instead; they should be recognized as historical value in the records. In this regard, the company may opt for the principle of continuity for the sake of not disclosing the financial position to the owners of the company. Consequently, it will cover the company image particularly, if financial status is low.

Economist argues that, the General accepted accounting principles that leasehold improvement should be written off over length of lease that include 39 years (Racine, 2010). There are loophole in that when one make leasehold improvement, one can end up allocating a lot of money to personal property for instance, fixtures, equipment which in such incidence may be shorter depreciable. In such aspect, the firm will not have broken the law but rather the law would be bent to suit the need of foresee the future achievement.

Typically, the company should not make things appeal better than they ought to; in addition, revenues are required to correctly stated. This implies that, when the firm is in debts or in cases when profits are declining, the company may follow the principle but may opt to explain why the businesses profits have declined; and promise the shareholders that the financial status will shoot. As said earlier, the company may opt to give information on what may have caused the loss without necessary breaking rule.

The paper has also discussed how a company may substitute principles with a different principle. For instance, in cases when the principle of utmost good faith is challenging the firm may opt for the principle of periodicity, which seems to agree on the fact that all information regarding the company should be revealed to the insurer after insurance policy process. Surveillance cameras enhance the level of security by preventing illegal activities and theft, Microform limits the storage space of documents while E-books play a fundamental role of storing files in a laptop, CD or notebook with no weight. Finally, videogames improve reading concentration through improving hand-eye co-ordination.

Budgeting for these materials is fundamental in that; most materials are brought by information science, which has gone beyond tradition methods of learning habits. Having established the progress that has occurred in technology with no doubt; for us to be competitive we require being equipped with materials that embrace the advanced technology in hand. BRIEF STATEMENT OF MATERIAL FACT

            The reason for judgment made by the Industrial Magistrate was that, the appellant had more that twenty years as Archbishop of the Greek Orthodox Church and all churches in Australia. The proceedings made indicated that the bishop was appointed by his church although still was a communion with the Ecumenical Patriarch. Archbishop was the senior cleric of spiritual affairs and the minister of autocephalous.

For many years before the proceedings, the Greek Orthodox community together with Hellenic cultural values had join in association in which they built churches, acquired land in addition, recruited the clergy of Greek Orthodox Church. It was at this point the industrial magistrate found that, Clergy was employed by the community in order to provide spiritual and religious matters that was seen as of the basic requirement within the culture of Hellenic Orthodox culture. In addition, these facts indicated that, upon appointment, the Clergy was acknowledged as an employee of the community and was subject to directing other leaders in his ministration.

Archbishop Ermogenous claim for payment, which he thought, was due for long service leave and annual payment from the Greek Orthodox community. Although he succeeded previously, the full court of Supreme Court of SA discovered there was no need to generate lawful relations between the parties. The appeal was later made to the high court.

The brief statements included contract intentions of creating contractual relations, whether engagement of minister religion was to create contractual relations and whether the primary decision-maker appeals had failed to consider the parties intention of creating contractual relations. On September 1994, Archbishop Spyridon Ermogenous made a claim within the industrial relation court of South Australia via the Greek Ortodox Community of SA inc for the total of money that he claimed it was for his annual leave together with long service leave.

He affirmed to have been employed by the respondent since 1970s and he had never received any payment for annual leave and long service entitlements.

PROCEDURAL HISTORY

            The case was previously heard in full Court of South Australia. Two issues were argued on the appeal to this court. Archbishop Sypridon Ermogenous had appealing of the decision of full court of Industrial relation court of South Australia in which the complainant claims against Greek Orthodox community of SA inc were discharged due to entitlements for due pay of annual leave with long service leave. With the case of Teen Ranch Pty Limited V Brown (1995) 87 I.R. 308, it was declared that, religious relations are never intended to create legal contract and constitutions binding. With this in mind, it created a presumption that, when dealing with spiritual associations there are no contractual agreement required. It is at this point that the high court of Australia of Emergenous case presumed that, these proofs would fall on the religious ministers thus making hard to create a contractual relationship. It was assumed that there were no intentions for creating legal relations. Therefore, the high court imposed a question of the party that had enough evidence towards the case.

The essential factor in Emergenous case was whether there was a deliberately intention of entering legally binding contract. Concerning this, Lord Denning MR in Merrit v Meritt (1970) 1 WLR 1211 affirmed that, if the court were to view situations in human concept, then, they would be reasonable regarding agreement intended to be binding. With this in mind, greater part of the high court concluded that, assumptions were not what was to guide the case but whether the parties projected to enter into a legally binding contract. Thirdly, whether the industrial Magistrate rightly held the relationship of parties regulated by contract enforceable at law and fourthly, whether the industrial magistrate made as a choice of the parties intending to abide into enforceable contractual relations having regard to spiritual matters. It was convenient for the present court to identify the chief features of legislative framework through which these issues were to be discovered. Additionally, there was appeal to be made on whether the relationship between the religion minister with the relevant religious body was concerned with spiritual matters that were self evidently true.

SUMMARY OF COURT ANALYSIS OF LAW

            The industrial court of South Australia established under Industrial Arbitration Act 1912 (SA) was summarized in Act (7) which sates that a contract is acknowledged as a common law through which contract of employment by which a person is employed nothing can hinder him or her from getting the benefits of the company. The majority of the members in the Supreme Court and full court as they stated that the distinction should be drawn between the church and the respondent as the honor said that the respondents were not the church in that appellant detained a clerical office.

DESCRIPTION OF HOW LAW APPLIED TO THE FACTS

            The law applied to the facts was found in several cases of relationship between religion ministers and the entire spiritual content in act (71). The religion ministers are concerned with spiritual a matter, which implies that, the minister should conduct his affairs with a lot of integrity. This follows that; the ministry should be governed through a contract. The respondent in this aspect was accused not to abide in this act of law. Instead, the respondent engaged only on spiritual facts and not a contractual relationship. Industrial Magistrate affirmed that, a minister for religion could not in law, considered as legal entity.

DECISION

ORDER MADE BY THE COURT

            While the case being heard, Greek orthodox were also added as respondents liable to paying Archbishop a total of $ 23, 989.35 for payment and annual leave of $ 10,672.80 for the total long service leave. Judgment was given for the total of these amounts along with interests’ failure to paying the amount.

SOCIAL OR CULTURAL CONTEXT

            It is essential to note that, the peculiarity of the arrangements between respondent and Archbishop was proved. He was still a Bishop within United States when he was come close to the respondent. The respondent persuaded him to quit his post within that country and settle in Australia. What followed was assumed a unique arrangement that was influenced with cultural or else ethnic body. Reports indicate that, the respondent had encouraged Greek culture within South Australia on the broadest sense. Never at any time, did the respondent cut his spiritual and ecclesiastical relationship with Ermogenous together with the church as whole. The judges and the Industrial magistrate of industrial Relations court were aware of these features of the contract that Ermogenous sought to impose.
