Indigenous Australian Law – Discuss this extract from Justice Toohey?s judgement in Mabo and compare his position with the Australian jurisprudence on proof of native title.

Discuss this extract (below) from Justice Toohey?s judgement in Mabo and compare his position with the Australian jurisprudence on proof of native title.
?The requirements of proof of traditional title are a function of the protection the title provides. It is the fact of the presence of indigenous inhabitants on acquired land which precludes proprietary title in the Crown and which excites the need for protection of rights. Presence would be insufficient to establish title if it was coincidental only or truly random, having no connection with or meaning in relation to a society’s economic, cultural or religious life. It is presence amounting to occupancy which is the foundation of the title and which attracts protection, and it is that which must be proved to establish title. Thus traditional title is rooted in physical presence. That the use of land was meaningful must be proved but it is to be understood from the point of view of the members of the society.? Mabo v Queensland (No 2) (1992) 175 CLR 1, 188 (Toohey J).

Reaction paper of growth trade and deindustrialization Rowthorn and Ramaswamy

Methodology: Critiquing Arguments Think of this as How to be an economist Method: 1)Replicate the argument 2)Identify assumptions 3)Change an assumption 4)Argue to conclusion Same conclusion? Go to #3 New conclusion? Go to #5 5)Verify empirically or argue rhetorically in favor of the validity of your alternative assumption No more than 500 words please. This paper is based on grading ruburic. so please follow it. I attached the article and ruburic files. Use quotations at least 2 in the article.

The article talks about “Why the decline in manufacturing?”
• Which of these two explanations is most powerful?
1. Internal factors
– Substitution effect due to price changes due to differences in
productivity growth
– Income effect due to rising income causing shift in demand from
manufactures to services
2. External factors
– Increased trade leading to substitution of manufactures for
services

Results
• Data: 1963-94 for 18 industrial countries
• Income
– Demand for manufactures increases at a decreasing rate
– Key is “where’s the turning point?”
• Productivity growth captured with price effect
– Higher productivity, lower prices, higher quantity demanded
– Offsets part of income effect
• Trade
– More net exports of manufactures increases manufacturing
– But little (if any) effect of imports from low-wage countries

Arms Trade Treaty_ USA

This essay is going to be contributed to one of the huge assessment (which is a group of simulation of the ARRIA FORMULA meeting about the Arms Trade Treaty). Basically, it is a role play, and there are 8 people going to play this (include: P5, NRA, Amnesty International and Oxfam). I am representing Rosemary DiCarlo (Deputy who actually attended the conference), and going to be at USA position to discuss about the ATT. So this essay is going to be focused on USA’s perspective, and the topic is going to be about An informal meeting focusing on convincing the P5 to ratify or not to ratify:

– Ammunition: Need for more key specification of Ammunition
– Definition: Overriding risk
– Transparency and Reporting .

– Definition: Over riding risk (levels-how countries determine what is dangerous, genocide, war crimes), scope- whether we include non state actors (issue posed by Syria) and people who occupy the land (issue posed by Iran)
– Transparency and Reporting

These points will determine whether or not your country will chose to ratify and clauses they may suggest if they choose to ratify parts.

Instructions: 1) the relevant areas of international law and international institutional law that are central to your simulation topic; 2) the key characters and institutions that are relevant to your simulation topic; 3) a character profile of your own character in order to provide a detailed profile of the character you play in the simulation (only information relevant to the simulation topic is required). The third part is the most important part, and it should include not only USA’s own perspective to ATT, but also need to show how other 7 character nations are effected by that (but from USA perspective).

Other information from our professor about the essay:

Treat it as a standard academic essay in terms of the referencing but you can use sub-headings for the criteria and also bullet points where appropriate such as re the other actors (short description of each useful in terms of relevance to the simulation), so in many senses a report format/structure. Given the word limit this format will be the most effective (re that make sure you attach a bibliography regardless of referencing format, but it won’t be part of the word count).

Re the aims that’s essential, and likely outcomes/resolutions very useful as it shows good group development and engagement with the issue (but not absolutely essential in depth at this point as from experience the next three weeks all groups focus, develop and nuance their outcomes/resolutions considerably!)
