Keisha Lowell is a famous singer, actress and dancer from Australia. She is better known to her family, friends and fans as K.Lo. Keisha and her business partners have used her celebrity status to establish K.Lo as an internationally-recognized brand name. Her attorneys registered K.Lo as a trademark in several countries around the world.

In 2010, stores began selling Keisha’s product line for women under the K.Lo brand. The products include high-end clothing, cosmetics and perfume. Currently 42 stores worldwide sell K.Lo products and their sales are estimated to generate revenue of over Dh 40,000,000 annually. Several stores in malls in Dubai sell K.Lo products.

In 2011, a business consultant and entrepreneur from Toronto, Canada named Kay Lowe relocated to Dubai with her husband. Kay opened a women’s clothing store under the name KayLo in Deira City Centre mall which sells inexpensive clothing for women. Customers may also order products from the company’s website at www.KayLo.com.

Problem Statement
During a business trip to Dubai last year, Keisha became aware of the KayLo store. Her attorney immediately sent a letter to Kay Lowe and demanded that she stop using the name KayLo for her store and clothing. Kay refused. Consequently, Keisha’s attorney filed a lawsuit in the Dubai Court of First Instance against Kay and the KayLo clothing store alleging trademark infringement.
