Taxation Law

On 1 July 2012 Lee commenced business as an architect. He operated as a sole proprietor from a converted garage at the rear of his residence. Much of his work consisted of preparing building designs and specifications for local council building permits but he quickly gained a reputation for quality drawings prepared within tight time frames. By the end of 2012/13 he had a small client base of local builders and private referrals and billings (fees) of $75,000. During the year Lee submitted a design as part of a national competition for the Citadel, the centrepiece of an urban redevelopment. His visionary design and revolutionary use of local materials left the judging panel speechless with admiration and, to national acclaim, he was awarded the prize and commissioned to build the structure. Immediately he borrowed $1 million, rented premises on Main Terrace, acquired state of the art equipment and employed six draughtsmen and two administrative staff. During 2013/14 his billings were $1.75 million.
Required
Should Lee return on a cash or accrual basis in 2012/13 and 2013/14?
You must refer to appropriate case law. Your answer must include (but should not be limited to) a discussion of the following:
• What factors affect the choice of a cash or accrual basis?
• Does Lee have a choice of the basis he adopts?
• Does the Commissioner of Taxation have a right to insist on a particular basis?
• Should Lee’s basis be the same in both years?

Refer to Question

Question:
Rousseau opens his ‘Fifth Walk’ recalling the two months he spent on the Island of St Pierre happily basking in nature and dedicating time to idleness and solitude. Later, he reveals that he was not entirely alone on the Island. Wordsworth’s speaker also opens the poem, ‘Tintern Abbey,’ recalling the secluded scene of the banks of the Wye, which reflect his own secluded thoughts. Later, he, too, reveals the presence of a companion – his sister Dorothy.
In the light of this observation, examine Rousseau’s and Wordsworth’s paradoxical sentiments towards solitude and the self.

You must successfully integrate into your discussion at least 3 secondary critical sources. One of these critical sources must originate from the Norton Critical Editions or from the archival repository, JSTOR.

The assignment requires you to analyse the current situation, identify and specify the organisational issues, and suggest practical and probable solutions. The secondary purpose of this assignment is to give students the opportunity to enhance their research, analysis, critical thinking and written communication skills; particularly in the areas of argument development and essay writing.
Before starting this assessment please read the marking criteria (at the end of the document) and refer to Academic/ Argumentative Essay on the Learning Skills Unit’s website:
https://www.cqu.edu.au/current-student/international-students/student-support/learning-skills-unit/resources
The course website also provides useful information in regard to the development of this assessment item.
Description
Assessment task 2 requires the writing of an academic/ argumentative essay. This essay should be an ‘argumentative essay’, and must therefore contain arguments that are used as the structuring elements of the assignment. The assignment is based on a case study that describes the impact of leadership, structural changes and change management on business activities. The purpose of the essay is to identify the roles of change in organisational leadership, resistance to change management, the change management process and other challenges in managing dynamic organisations. Students are expected to engage in extensive research within the academic literature relating to organisational leadership during change management, the change process, and resistance to change management.
Details
The assessment item is based on the case study titled Super Star University (pg. 504-508 of textbook: Organisational Change Development and Transformation by Waddell et. al., 5th Edition, Cengage Learning). The case will be available on the Moodle site under the Assignments tab. You should read, and carefully analyse, the case and respond to the issues presented at the end of the case study within the context of an academic/ argumentative essay. You are required to support your argument with appropriate theoretical discussion and references.
The assignment should be a properly constructed academic/ argumentative essay. It should contain an effective introduction, discussion body (answering the questions) and conclusion. The introduction should introduce the essay, thesis statement (main objective of the assignment) and include your argument. The main body of the assignment should present the evidence you have collected to support your arguments for the questions and the conclusion should restate your arguments, summarise the evidence and make a conclusion regarding your arguments.
The assignment should contain a coherent, but necessarily restricted review of the academic literature on the organisational leadership during change management, change process, and resistance to change management topics in question. The literature review should be integrated into the assignment, not a separate section. A reference list formatted in the prescribed Harvard style is compulsory. Do not include a bibliography. Further information regarding formatting of assignments and other information is available at https://www.cqu.edu.au/about-us/service-and-facilities/referencing
This assessment item involves researching your assigned topic to enhance your understanding of organisational leadership during change management, the change process, and resistance to change management strategies and the utilisation of academic literature. Whilst you should avoid using only the textbook, the prescribed textbook for the course should be cited in regard to broad change management strategies. You will be expected to present information and evidence from, and cite, at least fifteen (15) relevant peer-reviewed journals or other academic references (books, book chapters etc.) (minimum requirement). Refer to your recommended readings for examples of academic journals. While you can cite these references, you must find fifteen (15) peer reviewed journal articles and/ or other academic references not listed in the course materials. The quality and number of citations will demonstrate the breadth and depth of the literature used to answer the questions. It is strongly recommended that you use recent (within the last five years of publication) and relevant references. You may only use references more than five years old if those references are seminal (major ideas generated, proposed theories etc.) in nature. Also, it is strongly recommended that you do not use long quotes in assignments as it undermines your argument. Please check the following databases for journals and other academic references for the assignment. You may access the databases through the CQU library page. Your marker is interested in the analysis that you have developed from your review of the literature and how well you use the literature to respond to the topic. Avoid presenting a descriptive account only of your readings. What is required in this assessment is a critical evaluation of the academic literature as it relates to the specific details of the case study. Your marker is interested in the conclusions that you arrive at from your evaluation of the literature and of the case study.

You may relate the answers to table 4.1 and 4.2 (pages 93-96 of the textbook, chapter 4) and further integration of the case context, academic references is necessary. For the second part of the question, please check pages 100-121 of the textbook, chapter 4.
